Employers: have you remembered to submit your Employment Equity Reports?

submitI thought I’d be nice and send you a reminder that 1 October is the deadline for designated employers to submit their Employment Equity Reports to the Department of Labour.

So, how do you know if your organisation is a designated employer?

You’re a designated employer if:

1. You employ more than 50 employees (this includes part time employees and temps if they’re with the organisation for more than 3 month but excludes genuine independent contractors).

2. Your annual turnover is greater than the amount stipulated in the thresholds below:

  • Agriculture R2 million
  • Mining and Quarrying R7.5 million
  • Manufacturing R10 million
  • Electricity, Gas and Water R10 million
  • Construction R5 million
  • Retail and Motor Trade and Repair Services R15 million
  • Wholesale Trade, Commercial Agents and Allied Services R25 million
  • Catering, Accommodation and other Trade R5 million
  • Transport, Storage and Communications R10 million
  • Finance and Business Services R10 million
  • Community, Social and Personal Services R5 million

If your organisation is a what is classified as a ‘small’ employer (employs less than 150 employee), once you have submitted your first Employment Equity Report, you are only required to submit a Report every second year that end with an even number (2010).

The Department of Labour is trying to encourage organisation to submit their Reports online and as such have extended the deadline for online submissions to the 15 January 2010 for this year only (hardcopy/faxed/ emailed reports still have 1October 2009 as the deadline).

If your organisation is a designated employer, its worth taking the submission of the Employment Equity Report seriously- the Department of Labour is becoming increasing stringent and the possible fines are significant (starting at R500 000).
